1. Acceptance of Terms
By registering for, accessing, or utilizing the NextIn real-time queue management platform, you (the "Healthcare Provider" or "Clinic") agree to comply with and be bound by these Terms of Service. If you do not agree to these terms, you are prohibited from utilizing the system.
2. Data Protection & Privacy (DPDP Act 2023 Compliance)
We prioritize the privacy and protection of patient personal data in strict compliance with the **Digital Personal Data Protection (DPDP) Act, 2023** and applicable rules under the **Information Technology Act, 2000** of India:
- Data Minimization & Usage: Patient names, phone numbers, and visit tokens logged during OPD walk-ins are captured solely for queue management and SMS/WhatsApp notifications.
- No Commercial Exploitation: We **never** sell, monetize, rent, or share patient data or medical visit histories with third-party marketers, insurance brokers, or external entities.
- Data Localisation: All primary databases and backup infrastructure storing patient and clinic records are hosted locally within secured **data centers in India**.
- Consent Responsibility: Healthcare providers and clinic staff are designated as Data Fiduciaries and are responsible for obtaining appropriate consent from patients or parents/guardians before registering minors into the queue.
3. Subscription & 14-Day Free Trial Policy
NextIn offers a 14-day fully featured free trial upon account creation. No payment card details are required during registration. Upon trial completion, workspaces must subscribe to an active plan to maintain operational queue services. Workspaces that expire retain access to export their past patient logs for up to 30 days post-expiration.
4. Limitation of Liability
While NextIn strives to maintain a 99.9% platform availability, the service is provided on an "as-is" and "as-available" basis. We are not liable for queue delays, local internet failures, or clinic scheduling issues resulting from network outages or routine maintenance windows.
5. Governing Law & Jurisdiction
These Terms, Privacy Policies, and any legal disputes or claims arising out of or in connection with the use of NextIn shall be governed by and construed in accordance with the **laws of India**.
⚖️ **Exclusive Jurisdiction:** All legal proceedings, arbitrations, or disputes shall be subject to the exclusive jurisdiction of the competent courts located in **Sultanpur, Uttar Pradesh, India**.
